The previous law only protected security of tenure and allowed removal by impeachment, it is not the same as immunity from legal liability for all official acts.  
There was no legal immunity from legal proceedings before 2023 law.

What RaGa has shown are discrepancies in the electoral roll due to bureaucratic, administrative inefficiencies, over-worked govt school teachers and labour migration. 

Statistically, in a voting population of about ~100 crores, it's not inconceivable to think there would be some inconsistencies. 

Why these allegations haven't gained traction, like they should have, is because every political party and  people who have seen the process up-close know this happens all over the place. 

Everybody on social media has seen the videos showing govt teachers in small towns, villages don't know basic spellings. That's your BLO. In what world do you expect them to maintain and update clear records? 

Why was Rahul Gandhi, Congress and MGB fighting for elections in Bihar when they knew it was rigged? They should've been on a dharna instead they were all rallying. 

The only thing I've found questionable till now, is why the ECI is not using the de-duplication software on the rolls after the SIR. 

Moving to courts, and then failing to establish any blatant manipulation, you ultimately risk the rest of your political career and your party's rapport, legitimacy in the eyes of the public.

I think he has realized the only way he can overthrow BJP is if he brings anarchy in India.

It's multi-fold i think

1. A case filed would probably mean it can't be discussed on public platforms.
2. The SC could possibly take a softer stance on ECI. SC has a history of doing that since ECI is a constitutional body. 
3. Even if the end result comes out to be in favor of the opposition, that wouldn't necessarily mean electoral gains. The electoral bonds judgment is a good example of that - even after visible corruption trails, the BJP has still been able to seem anti-corruption in the public eye. 

Considering all this, the best way for the Congress, or any political party for that matter is to forge public opinion. The 2G scam is a good example - was instrumental in the decline of the Congress but all the accused were eventually declared innocent by the CBI Court. 

In a democracy, public opinion is what actually brings change and it seems like that's what the INC is trying to do.

One thing that I've been vocal about and as someone who's close to a lawyer, if you want your case to be in public eyes (In this case, ofcourse RaGa would want public attention to this matter), never file it in the court. When the matter becomes sub judicial, you can't have public speeches about it, and in cases, the court can even ask you to remove previous press conference or releases from public domains.

Any person who is not completely stupid would not petition the court as per my understanding. First and foremost according to the new laws bought in recently by gov, the ECI head cannot be prosecuted for any crime. So basically he is above the law in plain simple language. Now if you create a case and name other people or the institution or whatever - the court can impose restrictions of discussions on the case in public.  The gov can also keep delaying it forever and other such tactics. 

Also the OP is acting a lil naive - road accidents with clear video evidence don’t lead to prosecution - this is a completely different ball game. 

The only way you win or create a big enough threat is if you present enough evidence directly to the public and try to make it stick

Just look at cases where cases were filed. Look at how eci has been dodging notices to share election data and look at what happened when actual vote chori was caught in Chandigarh, look at the punishment. 


It is also worth noting that creating a case might mean a gag order on active investigation meaning rahul gandhi can't use it for political gain. A mistrust in the Indian judiciary is also a reason. Worth noting that laws have been changed to favour the eci before, they can be again. Worth noting that discrepancies don't mean vote chori but that might mean counter lawsuits by a party that has a lot more funds. 


These are just off the top of my head, I attribute it to political gain and lack of trust in government institutions mainly.

A few reasons I could think of:

1. The competition has always been between Congress and BRS. Reason is not just because of 35% minority votes but also because BJP doesn’t have grass roots level strength in that area.
2. BRS has failed to raise any significant issues with Congress government or build public perception against Revanth Reddy. Let’s not forget it’s been less than 2 years he has been in power. Too early for anti-incumbency 
3. The opinions of this sub are largely of English speaking urban residents of Hyderabad, many who don’t live here or don’t have votes here. Even for those of us, who live and vote here, like me, I don’t think our opinions reflect the ground reality of people in Hyderabad or of Telangana at large. To add to this, I come from a rural neighbouring district of Hyderabad, reception of Revanth and congress has not been negative, as of yet. 
4. Most important factor is, in by polls the incumbent usually wins. This has been true for 7 out of 9 by polls held in the last few years in TG. Eatala Rajendar and Raghunandan Rao are the exceptions who won because of their massive following in those constituencies.

I've read this somewhere that India, having gone through centuries of colonialism and deprivation, has developed a psychological pathology of scarcity mindset. Meaning, if you go out and distribute ration for free, everyone, even people who eat three proper meals a day, will still rush, grab, hoard, beg, borrow, or take more than they need.
This doesn’t disappear easily. It becomes inherited in some way. It’s a kind of past trauma response. You can’t convince people otherwise because it’s their automatic, knee jerk reaction. No matter how educated they may be, they still behave like this. Plus, given majority of the population is still poor it only makes sense. 

I think the same applies to civic sense. A large section of the Indian population comes from poor, neglected, or unstable backgrounds, and because of that, basic civic discipline is weak. It’s the same scarcity psychology playing out at a societal level.

There are diseases that happens only in poor. This is a bit out of context but help you understand that, diseases like TB although infectious but was eradicated in poor in Europe as country got richer. This is from the textbook. 

If everyone in india got above certain standard its possible that they actually develop thinking critical. Automatically develop civic sense of atleast some sort.


If you notice, the Black African population in America seems to suffer something similar as well, not as a generalization but as an observation. There is often poor civic sense, a scarcity mindset, and a stronger pull towards freebies. There must be some kind of psychological response or deeper interplay behind this pattern.

What do you even mean by “no development”? Compared to what? Do you think the previous governments were doing some massive development we all missed? Rigging happens in every election, in every country and has happened since always. All parties do it. It impacts results but cannot to this extend. It takes lakhs of people to conduct elections in India, something on this scale cannot be suppressed.
